Legal Expenses Insurance

If you have been involved in any type of accident causing personal injury, you may have an insurance policy in place to cover your legal claim. There are some enquiries you need to carry out to see if you have legal expenses insurance. I will take care of these for you if you ask me to help you with your claim.

First things first

Before starting your claim the court rules require me to check to see whether you have any insurance cover that you could use to fund your claim. (If you do not, don't worry. You can then go through my usual claims process, which means you have no fees to pay and no deductions at all from your compensation).

If you do have legal expense insurance then I will liaise with your insurers to obtain their agreement to Carter & Carter acting for you under the terms of the policy.

Be wary of offers direct from your insurer

Please note, on occasions legal expense insurers will contact clients directly without my knowledge to see whether they want to instruct a different solicitor under the terms of the insurance policy. The reason that insurers write to clients in these terms is because if the case is transferred the insurers receive a referral fee from the new solicitor! It has to be said that whilst it may be in the insurer's commercial interests to see a client transfer their case it will not necessarily be in the client's best interests - you may be assigned a less experienced practitioner.

I can and will still help you even where the legal expense insurer insists on you using their nominated solicitor. In short, I believe that I can look after you and protect your interests better than anyone else. Put me to the test and see if you agree!

How does the funding work if I'm using a legal expenses policy?

If you do have the benefit of a Legal Expenses Insurance Policy, then if there are any costs for you to pay these will be met by your insurer subject to their terms and conditions. From experience it is likely your policy document will include standard provisions which specify that:

  • There needs to be reasonable prospects of succeeding with your claim;
  • You need to co-operate in terms of pursuing the claim as well as helping to recover any legal costs from the other side;
  • You need to follow advice given by your legal advisors;
  • You agree not to contact or communicate with the other side or their representatives.
