Slip Trip and Fall Compensation Case Study
David Healey, a specialist
“We received a call from the father of a young boy who had been seriously injured after he fell from a set of stairs whilst getting off a boat at their local harbour. The stairs had a handrail but the client had lost his footing and fallen which resulted in a serious injury to his elbow which required immediate surgery. On first glance the staircase seemed safe but we agreed to take his case on as we decided that there were options which the Harbour could have taken but didn’t.”
Liability/Blame for this slip trip and fall compensation claim
“This compensation claim was made against the Harbour because in our opinion, they failed to have a safe means of entry and egress from the water. We argued that they failed to maintain the Harbour stairs in an efficient state and failed to take adequate care for the safety of our client.
It struck us that they failed to carry out appropriate risk assessments and as such they had failed to discharge their duty of care under the Occupiers’ Liability Act to see that our client was safe whilst he was visiting their premises.
The Harbour point blank refused to accept any blame for our client’s accident compensation claim but after careful legal arguments we convinced them that they should deal with the claim which they agreed to do. Our client received the accident compensation which he greatly deserved as well as specialist therapy to get him back to how he was before this unfortunate accident.”
