Step 1
An Equine Solicitor will speak to you immediately, take the necessary information and tell you there and then whether your Horse Riding Injury claim is likely to be successful.
100% of our Horse Riding Injury Claims are made on a No Win No Fee basis which means that you do not have to worry about any financial risk at all as if your claim is unsuccessful it will not cost you anything.
Letter of Claim
Once we have taken all the relevant information we will be able to start your Horse Riding Injury claim against the appropriate Stables, company or individual (known as the Defendant).
We will send a detailed Letter of Claim to the Defendant setting out:
- What happened
- Why we believe the injuries are their fault
- Brief details about your injuries
The Stables, company or individual are supposed to reply within 21 days with their Insurance Details. Then they must let us know if they accept fault within 3 months.
Equestrian Expert
Right at the outset of your claim, we will speak to an experienced Equestrian Expert about your accident and seek their opinion about areas of negligence which we can raise.
Medical Evidence
As soon as we receive the Insurance Details from the Defendant we will obtain your medical records and arrange for you to be examined by a medical expert so we have detailed evidence about all your physical and psychological injuries.
Getting medical evidence at this stage lets us place a value on your Horse Riding Injury Compensation Claim and allows us to issue Court Proceedings if the Defendant’s Insurers fail to accept blame within the 3 month period.
Financial Losses
You will complete a very straightforward questionnaire listing any financial expenses you have incurred as a result of your injuries. The things you can claim for is almost endless but usually includes things such as:
- Loss of Earnings
- Gym Fees
- Taxi Fares
- Bus Fares
- Parking Fees
- Medication/Prescription Fees
- Treatment Fees
- Damaged Personal Effects
- DIY Costs
- Loss of Promotion
- Loss of Pension
Settling your Claim if the Defendant Admits Blame
If the Defendant’s Insurers accept fault for your accident we will be able to settle your claim as soon as you have made a reasonable recovery. We will have carefully reviewed your medical evidence and as such can carefully consider any offers made.
You should remember that all offers are put forward on a full and final basis regardless of future developments. This means that before accepting an offer you should be confident that you have made a full recovery or, at the very least, you are satisfied that you will make a full recovery within the period identified by our medical expert in his/her report.
If you have any doubts, whatsoever, about not making a full recovery from the effects of the accident, in line with our medical expert’s prognosis, then we would recommend you defer accepting any offer so we can monitor your recovery.
If you decide to accept an offer and continue to suffer with your symptoms for longer than anticipated, you would not be able to claim additional compensation if you suffer into the future.
Settling your Claim if the Defendant Denies Blame
If the Defendant’s Insurers refuse to accept they were at fault, we will issue Court Proceedings against the Defendant to move your claim into the Litigation Process. This is nothing to be worried about as only 1% of claims get as far as a Trial.
How long will the claim take?
This all depends on the severity of your injuries but we estimate that if your injuries do not involve surgery or serious injury, your claim will be resolved within approximately 3-6 months if the Defendant accepts blame for the accident. If the Defendant does not accept blame or you have suffered from serious injuries, the claim could take up to 12 months or more.
Rest assured that we are very proactive so that you can put the episode behind you as quickly as possible. We have already won significant compensation for clients who have had a Horse Riding Injury and know how important closure is.
